Journal of the Justice Academy of Turkey, vol. 5, 2011, p. 419-450

The New Turkish Commercial Code which superseded the Turkish commercial code no 6762 had difficulties to respond to the needs of the day has brought a new dimension to the commercial agency relationship. During the gaps of the old law, the problems related to the indemnity of goodwill, commission charge and problems arising from the termination of the contract were resolved limited by court decisions. New commercial law especially regulated commission charge, indemnity of goodwill, agreement about prohibition of competition detaily. Generaly we can say that, the basic logic of old law continues with the new commercial law. On the other hand we can predict that most of the problems will be resolved on practice. One of the basic character of the new law is, laws for protecting commercial agency who has usually economically weak is regulated as imperative provision. http://www.humanlawjustice.gov.tr/Upload/Dergiler/taad5/index.html
